1. Definitions:
a) 'Pets Domain' mean Pets Domain Pty Ltd ABN: 45 127 801 389
b) '+Plus club' mean the Pets Domain +Plus membership club.
c) 'Applicant' means an individual who has made an application to become
a member of the Pets Domain +Plus membership club.
d) 'Member' means an individual who has been approved and accepted by Pets Domain to the +Plus membership club.
e) 'Card' means a membership card which has been issued to a Member upon approval of a valid application to the Pets Domain +Plus membership club.
2. In order to apply for a membership to the +Plus club, the Applicant must complete this application form in full, and hand it in to any Pets Domain store.
3. By completing an application form for membership to the +Plus club, the Applicant accepts and agrees to be bound by these Terms and Conditions.
4. Pets Domain holds the right to accept or refuse any application for membership to the +Plus club.
5. A Member may only hold one membership to the +Plus club.
6. Upon approval of application to the +Plus club by Pets Domain, the Applicant will receive a membership card by mail. Upon acceptance of the membership card, the Member agrees there is a legally binding agreement between the Applicant and Pets Domain Pty Ltd, which is bound by these Terms and Conditions.
7. The allocation and availability of benefits arising from membership to the +Plus club are determined by Pets Domain and may include discounts or other special offers for products purchased at Pets Domain stores. Pets Domain holds the right to cancel or change any offer at any time without prior notice.
8. Where promotions or special offers are made available to Members, that offer will only be available to Members, upon proof of membership by presentation of their +Plus club membership card.
9. Promotions, special offers and other benefits made available to Members may not be used in conjunction with any other offer or promotion.
10. Member discounts are not available on products or services that are already marked as reduced or special prices, as determined by Pets Domain.
11. Any rights or benefits assigned to a Member are non-negotiable, non-transferable and are not redeemable for cash.
12. Pets Domain has absolute discretion to cancel or terminate Membership of any Member at any time.
13. All +Plus club membership cards are the property of Pets Domain.
14. If a member decides to cancel or forfeit their membership at any time, Pets Domain must be notified and the +Plus club membership card must be returned to Pets Domain.
15. Pets Domain reserves the right to terminate the +Plus club at any time without any prior notice.
16. Pets Domain accepts no responsibility for any tax implications that may arise from being involved with the Pets Domain +Plus club.
17. Each Member indemnifies Pets Domain and accepts all responsibility for a stolen or lost Card or a Card that is used fraudulently. If a card is suspected of being lost or stolen or used fraudulently the Member must , as soon as they become aware, repeat the incident to Pets Domain. Pets Domain in its absolute discretion may cancel the existing Card and may issue a new replacement Card.
18. Pets Domain shall not be liable in any way if benefits or promotions are unavailable as a result of events outside the control of Pets Domain including any technical malfunction, operator fault, errors resulting from computer hardware or software errors or failure.
19. Pets Domain reserves the right to vary these Terms and Conditions at any time for any reason and without notice.
20. To the extent permitted by law, Pets Domain provides no warranty and shall have no liability in respect of goods or services provided to Members or as to the accuracy of any description or information about such goods or services.
21. Each Member indemnifies Pets Domain for any injury, loss or claim (including any indirect or consequential loss) of any kind to any person or property suffered by any act or omission, deliberate or negligent of Pets Domain in connection with the +Plus club, including injury, loss or claim resulting from participating in any activity of the +Plus club, or in any activity in which Members are invited to participate. This condition is subject to any liability which may not be lawfully excluded, in which case such liability will be limited to the extent permitted by law.
22. Pets Domain makes no warranty or representation as to the quality, suitability or merchantability of any goods or services offered or received by Members in connection with the +Plus club.
23. Each Member indemnifies Pets Domain for and against any loss or claim suffered or incurred by Pets Domain or any other party arising from or in connection with a breach of these Terms and Conditions by a Member.
24. Pets Domain holds and uses Members personal information in accordance with Pets Domains' privacy policy, which can be obtained through www.petsdomain.com.au
25. Pets Domain's decision in connection with any aspect of the +Plus club will be binding and final on each Member and no correspondence will be entered into.
